Nissan Motor vs. Nissan Computers

What happens if somebody else registered your brand name as his domain name? Search for another "good" domain name? Or lawsuit?
Nissan Motor, one of the big corporations in the world took many legal actions against Nissan Computer, which is a small Computer trade company in North Carolina, US for using nissan.com domain name but with no success.
Mr. Uzi Nissan, the founder and president of Nissan Computer registered nissan.com domain name in 1994.
Nissan Motor's domain name is: nissan-global.com

Important: Do not lose your "good" domain name!!!

we can always check domain name availability at http://www.whois.net/

if the domain already registered by some other party this site will suggest to you a nice domain name to consider.. if you still need that domain name then Lawyer may be needed. but how many successful case is there?

Personally, I think there is nothing we can do if some party already register such domain name earlier.. the choice is yours..

in my home country I check domain availability for .my at this site http://www.mynic.my/

If I were Nissan... I would consider buying the URL from Nissan Computers.

Yes.. I would suggest that too.. but then Nissan motor should prepare to spend lots of money on this. Is it worth? For the credential and pride maybe it is worth. How about value proposition on the URL name? ROI?

Well, Muneer made a good point about value proposition on url name vs. roi, actually I don't believe a nice domain name alone will mean success anyway. I always love ebay example, basically Omidyar, the eBay founder, had tried to register the domain name echobay.com but found it already taken by the Echo Bay Mines, a gold mining company, so he shortened it to his second choice, eBay.com. Wiki

The fact that many people use eBay was not because of its URL but the value of the business. eBay offers its value to consumer by solving the simple problem that people want to exchange their 2nd hand goods.

So if I were Nissan motor, I rather focus on making my car than spending my time on this. so why they name it nissan-global.com, I think nissanmotor.com maybe well represent their core business and core capability. Don't you think so?

I agree. For the purpose of domain name, nissan-global.com is very good and enough, and they should concentrate on their core business.

Especially in Japan, I think domain name is not so important because we seldom type the url. In general, we Japanese are not good at typing English, so many of us use only search engines. Therefore, when I heard the fight related to domain name or fat finger story in class (registeration of the wrong url for mistyping), it was very interesting and strange for me..

Well, guys, please think about following questions carefully.
- How many users type in their web browser's address bar nissan.com to enter Nissan Corp's web?
- What will you type in the if you were going to search Nissan's web site? For sure, "Nissan"
- Thanks to Nissan Motors, Nissan Computer could save a lot of money from its advertisement budget. ;)

It is true that multilingual Internet Addressing is becoming popular in non English speaking countries. Just simply type in our own language, own character. Very nice, simple, no headache. But, remember that English still dominates in Internet world. Secondly, the technology issue. There is no single multilingual internet address exists. It MUST have a domain name.
Finally, domain name is very important for eMarketing, especially "good" ones.
